Classbuk is committed to protecting your privacy: it’s the foundation for a safe and trusted community. Our privacy policy outlines what information we collect from you, how we use that information, and what choices you have regarding how and whether we can use your information. Because Classbuk is a learning environment for children, we take additional measures to safeguard children’s privacy. We respect your privacy and are committed to maintaining and using any information we collect through your use of our Services responsibly.

 

This Privacy Policy applies to the Classbuk websites and related subdomains, mobile applications, and media (our “website”) managed by Present Minds Private Limited. (“Classbuk”, “we”, or “us”), and the online course creation platform that enables teachers (“Teachers”) to deliver live and recorded instruction, digital goods, and learning services as massive open online courses and classes (“Classes”) to end-users (“Learners”) through the Classbuk site. Our website, platforms, online course/class creation platform, and related services are hereinafter collectively referred to as our “Services”.

 

 

Please read this Policy before using the Platform or submitting any of your personal information to Classbuk. This Policy applies only to the information that Classbuk collects through its Classbuk Services, in email, text and other electronic communications sent through or in connection with its Classbuk Services.

This Policy is a part of and incorporated within the Platform and is to be read along with the Terms of Use.

By using the Platform and the Services, you agree and consent to the collection, transfer, use, storage, disclosure, and sharing of your information as described and collected by us in accordance with this Policy. If you do not agree with any of the terms of the Policy, please do not use or access the Platform.

Classbuk is the data controller for the processing of personal data in relation to Classbuk accounts and in relation to the use of our website. Each individual Store/class is the data controller for non-Classbuk accounts, Teachers’ personal data, and for any processing conducted in relation to the online classes or courses provided by the Store.

This Privacy Policy only concerns the processing for which Classbuk is the data controller. If you have any questions regarding processing for which a Store/ Class is a data controller, please contact the relevant class/store teacher.

The Information We May Collect:

Our primary purpose in collecting information from or about you is to provide you with a safe, smooth, efficient, and customized experience. Depending on the manner in which you use our Services, we collect information about you that we deem necessary for providing Services and features that optimize, secure, and ease your user experience.

 

Personal Information or Personal Data (“PII”):

Classbuk may collect and process information that could be directly or indirectly associated with you; information such as your full name, company name where applicable, user name and password, phone number, email address, billing or mailing address, credit/debit card information, and other information that you share with Classbuk. Credit/debit card information is not collected by Classbuk for payments through 3rd party payment gateways, UPI or through Banks.  You can choose not to provide us with certain information, but that may result in you being unable to use certain features of our Services because such information may be required in order for you to register for an account; purchase products or services; participate in a contest, promotion, survey, or sweepstakes; ask a question, or initiate other transactions on our website.

 

 

Payment Information:

For the purposes of billing, Classbuk Plan subscription fees or class fees and Classbuk powered class/ course enrollment fees are processed through 3rd party payment gateways or otherwise, we do not have access to or retain debit/ credit card information internally.

Third Party-Payment Processors:

Payments processed via Custom Payment Gateways by third parties like RazorPay, PayPal and Stripe and others are subject to the terms of use and privacy policies of those payment gateways and are not accessible or controlled by Classbuk. For additional information, we recommend that you review the payment processor’s Privacy Policy.

 

Information from Third Party Platforms:

You may allow our Services to interact with one or more third-party social networks or platforms (such as Facebook), which will provide data about you to us (“Platform(s)”). The information you allow Classbuk to access varies by Platform, and it is affected by the privacy settings you and those that you are connected with establish while using such Platforms. Platforms are operated, controlled, and maintained by third parties that are not operated, controlled, or maintained by Classbuk. We recommend that you read the terms of use or service and privacy policies of those Platforms to understand how they collect and treat your data and what data they might share with us or other third parties.

Demographic and Usage Data:

Classbuk may collect information through the use of cookies, HTML5 local storage, and other similar technologies. “Cookies” are alphanumeric identifiers in the form of text files that are inserted and stored by your web browser on your hard drive. Classbuk may set and access cookies on your computer or device to track and store preferential information about you. We may gather anonymous information about Users through cookie technology on an individual and aggregate level. Such information is used within Classbuk internally and is only shared with third-party advertisers, if any, on an aggregated or non-personally identifiable basis. You may opt-out of receiving cookies from our website by following the instructions in your web browser. Note, however, that deleting cookies or directing your browser to refuse them may limit your ability to use certain portions of our website that require cookies to function. Classbuk gathers certain information automatically and stores it in log files. This information may include Internet protocol (IP) addresses, browser type, operating system, and other usage information about the use of our website, including a history of the pages you view.

 

 

Cookie Policy:

Cookies are small text files containing a string of characters that can be placed on your computer or mobile device that uniquely identify your browser or device

Cookies allow a site or service to know if your computer or device has visited that site or service before. Cookies can then be used to help understand how the site or service is being used, help you navigate between pages efficiently, help remember your preferences, and generally improve your browsing experience. Cookies can also help ensure marketing you see online is more relevant to you and your interests. We may routinely use all categories of cookies on the Service. The length of time a cookie will stay on your computer or mobile device depends on whether it is a “persistent” or “session” cookie. Session cookies will only stay on your device until you stop browsing. Persistent cookies stay on your computer or mobile device until they expire or are deleted. You can adjust your cookie settings. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Services.

 

Non-Personal Information:

We may collect general information that will not personally identify you, such as the Internet browser, operating system, date of visit, time of visit, and the path taken through the website. Classbuk may also collect other Non-Personal Information as visitors browse our website, such as the web traffic, what pages are visited, and from where visitors come. We may compile this Non-Personal Information to enable statistical analysis of our Services that would be used internally or with external assistance to make improvements to our website and Services.

 

We will use your PII in accordance with applicable data protection legislation and this Privacy Policy

 

Disclosure of your PII

Classbuk provides to Teachers with the following information about the Learners enrolled in their respective Classes; Name, Age, city, and the Instructor’s Course in which the Student has enrolled. Classbuk does not disclose any other information about Learners to Teachers, and Learners assume full responsibility for the disclosure and use of any other PII the Student chooses to disclose to any Instructor or other users, which at all times shall be subject to the terms of this Privacy Policy.

 

Classbuk may also disclose any of your information, which in some cases includes PII, in the following situations:

  1. With your consent. Classbuk may transmit your PII to a third party when you give us express permission to do so. For example, this may occur when we complete a transaction on your behalf or at your request.
  2. With our authorized service providers. Classbuk may share your PII with our authorized service providers that perform certain services and process PII on our behalf. These services may include providing customer service and marketing assistance, performing business and sales analysis, supporting our website functionality, and supporting contests, sweepstakes, surveys, and other features offered through our website. These service providers may have access to PII needed to perform their functions but are not permitted to share or use such information for any other purposes.
  3. Payment providers and your bank. For the purpose of administering payments within our Services, we may disclose your PII to third-party payment providers and your bank.
  4. With our business partners. When you make purchases, reservations, or engage in promotions offered through our website, we may share PII with the businesses with which we partner to offer you those products, services, promotions, contests, and/or sweepstakes. When you elect to engage in a particular merchant’s offer or program, you authorize us to provide your email address and other information to that merchant.
  5. In connection with a substantial corporate transaction, such as the sale of our business; a divestiture, merger, consolidation, or asset sale; or in the event of bankruptcy. If another company acquires Classbuk, that company will take on all responsibility for the information we collect, including PII, and it will assume all rights and obligations with respect to that information. Should this happen, the acquiring company may implement its own policies with respect to your information.
  6. If we are required to disclose information by law. Classbuk may be obligated to disclose a User’s personal information if directed by a court of law or other governmental entity. Without limiting the foregoing, we reserve the right to disclose such information where we have a good faith basis to believe that such action is necessary to: (a) comply with applicable laws, regulations, court orders, government, and law enforcement agencies’ requests; (b) protect and defend Classbuk’s or third party’s rights and property, or safety of Classbuk, our users, our employees, or others; (c) prevent, detect, investigate and take measures against criminal activity, fraud and misuse or unauthorized use of our Services and/or to enforce our Terms of Use or other agreements or policies; and/or (d) protect your personal safety or property or that of the public. In the event that your information is disclosed, we will comply with the law and make commercially reasonable efforts to notify you.

Classbuk may also use and share Non-Personal Information we collect with third parties to develop and deliver targeted advertising on our website or applications of third parties and to analyze and report on advertising you see. We may combine Non-Personal Information we collect with additional Non-Personal Information collected from other sources. We also may share aggregated, non-personal information with third parties, including advisors, advertisers, and investors. For example, we may engage a third party acting on our behalf to collect web log data from you (including IP address and information about your browser or operating system) when you use our website and other websites you may access during your Internet browsing session, or place or recognize a unique cookie on your browser to enable you to receive customized advertisements or content. For more information regarding your choices about how third parties collect information about you on our website see the section titled Do-Not-Track Procedures below.

 

Please keep in mind that all of the information that you disclose or content that you post in your user profile, forum posts, comments, or other public portions of our website becomes public information. Because this information is publicly available, we cannot control how others treat it so we ask all Users to exercise care in deciding what information they chose to share.

 

 

Data Retention

We will only retain your personal information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, local, or reporting requirements. We will save your PII until you erase or delete your account or otherwise exercise your right to erase your PII. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information, and whether we can achieve those purposes through other means, and the applicable legal requirements.

In some circumstances, we may anonymize your personal information (so that it can no longer be associated with you) in which case we may use this information indefinitely without further notice to you.

 

 

 

 

Access to Your Information and other rights:

 

You are, at any time, entitled to receive a copy of the PII that we hold about you and information about the processing thereof unless already deleted. Please note that Classbuk needs to be able to determine your identity in order to be able to respond to your request.

If you believe that any PII we are holding is incorrect or incomplete please send an email with your specific request to support@Classbuk.com. We will work with you to make any corrections deemed necessary. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. All requests will be carried out by Classbuk as soon as reasonably possible based on your account activity

 

 

Additionally, note that registered Teachers and Learners may change the visibility of their respective personal information throughout our website by editing their personal profiles or delete and update your live classes, courses and course files directly from Classbuk should the website allow such feature in future.

 

 

You have the right to request that Classbuk restricts the processing of your PII under certain conditions. For example, if you contest the accuracy of the PII, the processing may be restricted for a period enabling Classbuk to verify the accuracy of the PII or if Classbuk no longer needs the PII for the purposes of the processing but you require the PII for the establishment, exercise, or defense of legal claims.

 

You have the right to have your PII deleted without undue delay and Classbuk is obliged to delete your PII without undue delay if, for example, the PII is no longer necessary in relation to the purpose for which it was collected or otherwise processed. Please note that Classbuk is not obliged to delete the PII if Classbuk can show that the processing is necessary, for example, for the establishment, exercise, or defence of a legal claim. Class recordings if deleted already cannot be shared and Classbuk will depend on 3rd party companies like Zoom. 

 

If you provide your email address to Classbuk, you will always have the opportunity to opt-out of receiving email newsletters and promotions by emailing support@classbuk.com or through the unsubscribe link in the email communications or by logging into and changing the preferences for your user account if the website provides. We may send you other types of transactional and relationship e-mail communications, such as service announcements, administrative notices, and surveys, without offering you the opportunity to opt-out of receiving them. Please note that changing information in your account, or otherwise opting out of receipt of promotional email communications will only affect future activities or communications from us. If we have already provided your information to a third party (such as a credit card processing partner) before you changed your preferences or updated your information, you may have to change your preferences directly with that third party.

You have the right to object, on grounds relating to your particular situation, at any time to Classbuk’s processing of your PII if the processing is based on, for example, legitimate interests. If you object to such processing, Classbuk will no longer be entitled to process your PII based on such legal basis, unless Classbuk can demonstrate compelling legitimate grounds for the processing which overrides your interests, rights, and freedom or if it is conducted for the establishment, exercise, or defense of a legal claim.

 

You have, under certain conditions, the right to receive the PII concerning you and which you have provided to Classbuk, in a structured, commonly used and machine-readable format and have the right to transmit such PII to another data controller without Classbuk trying to prevent this, where Classbuk’s processing of your PII is based on a contract or consent and the processing is carried out by automated means. In such case, you have the right to request that the PII shall be transmitted from Classbuk directly to another data controller, where technically feasible.

 

You also have the right to withdraw your consent, if applicable. If you withdraw your consent, please note that this does not affect the lawfulness of the processing based on your consent before its withdrawal and that Classbuk may, under certain circumstances, have another legal ground for the processing and therefore may be entitled to continue the processing.

If you are unhappy with our processing of your PII or of an alleged infringement of the General Data Protection Regulation or other applicable data privacy laws, you may lodge a complaint with a competent supervisory authority, for example in the country of your habitual residence or place of work.

 

Account Protection:

If the website provides an option to create an account, when creating your password please use unique numbers, letters, and special characters. We ask you not to share your password with anyone, if you do so, you are solely responsible for all the actions taken in the name of your account. If you lose control of your password, you may lose substantial control over your personal information and be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason or if you have grounds to believe that your password has been compromised, you should immediately contact us and change your password.

 

Security:

We have implemented appropriate physical, administrative, technical, electronic, and managerial procedures to safeguard and help prevent unauthorized access to your information and to maintain data security. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. The third-party service providers with respect to payment gateway and payment processing are all validated as compliant with the payment card industry standard (generally referred to as PCI-compliant service providers).

 

If you know or have reason to believe that your Classbuk Account credentials have been lost, stolen, misappropriated, or otherwise compromised or in case of any actual or suspected unauthorized use of your Classbuk Account please contact us.

 

We assume no liability or responsibility for the disclosure of your information due to errors in transmission, unauthorized third-party access, or other causes beyond our control. You play an important role in keeping your personal information secure. Despite our best efforts, however, no security measures are perfect or impenetrable. In the event where you believe your privacy has been breached, please contact us immediately

 

Our Policy Concerning Children:

We encourage parents and guardians to observe, participate in, and/or monitor and guide their online activity. Classbuk collects information about students directly from Parents, who provide us with the Child’s first name, age, type of schooling, location, and additional notes for the Teacher. In addition, Children may share information about themselves during Classes. The Classbuk class sessions may take place over online videos in which video images and audio of the Children are recorded. No information is collected directly from Children until they are in the course session. Children cannot post personal data publicly on the  Classbuk Services.

As stated in our Terms of Use, our website and Services are offered and available only to you if are 18 years or older, or if you are between 13 and 18 years old and have obtained the consent of a parent or legal guardian prior to accessing the website, registering an account, or using the Services. If you do not meet this eligibility requirement, you may not use our website or Services.

 

Classbuk shares the name, age, location, and any notes Parents have provided about their child to the course Teacher, in order to allow the Teacher to provide Classes. This information shall also be treated as part of the Parent’s Personal Data and may be shared as described in the Disclosure section above for business transfers; to vendors and service providers; and to comply with legal requirements. Children may also share information about themselves with the Teacher ( except contact information)  and the rest of their class during the Class session voluntarily. While Classbuk expects Teachers and all other Users to abide by our standards of conduct, please note that we cannot control or monitor what personal information your Child shares with Teachers or other classmates, nor what those third parties ultimately do with that information, and disclaim all responsibility in that regard.

 

Class Video Recordings: As described above, Classbuk records videos of students and teachers during Classbuk classes (“Class Recordings”). Please refer to https://www.classbuk.com/terms-conditions/ under the section Video Recordings of Live Online Classes for details

Parental Consent: Classbuk obtains verifiable parental consent before collecting Personal Data from your Child. If you do not consent, then we will not collect, use or disclose any personal information about your child, and your child will not be allowed to use the Services in any way.

Parental Choices and Controls: At any time, you can refuse to permit us to collect further Personal Data from your Children in association with your account, and can request that we delete from our records the Personal Data we have collected in connection with that account. Please keep in mind that a request to delete records may lead to a termination of an account, membership, or other services. You may update your Child’s information by logging onto your account, if Classbuk provides user account management function. You can contact Classbuk to request access to, change, or delete your Child’s personal information by sending an email to us at support@classbuk.com. A valid request to delete personal information will be accommodated within a reasonable time. In addition to the foregoing, we will exercise commercially reasonable efforts to delete personal information belonging to Children when it is no longer needed for the purpose for which it was collected.

 

 

Securing Your Information

Classbuk takes a range of security measures designed to protect your PII and keep it confidential (unless it is non-confidential by nature) and free from any unauthorized alteration. For example, only employees, interns and directors are permitted to access personal information, and they may do so only for permitted business functions. In addition, we use encryption in the transmission of financial information between your system and ours, and we use firewalls to help prevent unauthorized persons from gaining access to your personal information.

Where we have given you (or where you have chosen) a password for access to certain parts of our website, you are responsible for keeping this password confidential. As the safety and security of your information also depend on the precautions you take, we ask you not to share your password with anyone.

 

 

Third Parties and Other Information Collectors

Except as otherwise expressly included in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. To the extent that you disclose your information to other parties through our website, whether between teacher and Student or other Users or individuals, different rules may apply to their use, collection, and disclosure of the personal information you disclose to them. Since we do not control the information use, collection, or disclosure policies of third parties, you are subject to their privacy policies.

 

 

Our website may include links to third-party websites. Once you have used these links to leave our website, you should note that we do not have any control over third-party websites. We are not responsible for the content of such websites or the protection and privacy of any information which you provide while visiting such sites. Third-party websites are not governed by this Privacy Policy. You should exercise caution and look at the privacy policies applicable to the websites in question.

 

 

Do-Not-Track Procedures

Note that any Do-Not-Track instructions from your browser or similar mechanism will not affect our collection of the data that you voluntarily provide to Classbuk through such means as browsing our website, signing up for any of the Services or any Courses, entering PII into information fields on our website, or posting on any of our forums or blogs. Be advised that third parties are free to collect any information that you volunteer to Classbuk that is visible to the public. Therefore, please do not provide Classbuk with any information that you do not want to be collected.

 

 

Users Outside of the United States

The Services are governed by the laws of India. By using the Sites, you consent to the transfer of information to countries outside your country of residence.

 

 

Transfer of personal information to countries outside the EU/EES:

Classbuk is incorporated and based in India. Your PII is therefore transferred outside the European Union (“EU”) and European Economic Area (“EEA”). Such transfer is necessary for the performance of the contract between you and Classbuk (article 49.1 (b) of the GDPR).

 

 

The Teachers and Stores may also be established in countries outside the EU/EEA. Such transfers are necessary for the performance of the contract between you and Classbuk (article 49.1 (b) of the GDPR).

 

Your PII is also transferred to and processed by third-party payment providers (such as RazorPay, Stripe, and Paypal) and your bank where payment gateways are used. Such transfers are necessary for the performance of the contract between you and Classbuk (article 49.1 (b) of the GDPR).

 

 

No Rights of Third Parties:

This Privacy Policy does not create rights enforceable by third parties or require disclosure of any personal information relating to users of the website.

 

 

Changes to the Privacy Policy:

 

We may review and update this Privacy Policy from time to time in our sole discretion. We may update this privacy policy. In the event there are significant changes in the way we process your personal data, we will display a notice on this site. Unless stated otherwise, our current Privacy Policy applies to all information that we have about you and your account.
